To Users (as defined below), please be informed that the following Privacy Notice applies to you by simply using or accessing any of the pages, web and mobile applications, software, and general applications that make up the www.nemaloyalty.com Portal (hereinafter, jointly and indistinctly referred to as the "Portal"), which implies your acceptance of and agreement to comply with its terms. If you do not agree with the Privacy Notice and/or the Terms and Conditions available to you, you should refrain from accessing or using the Portal.

The User, defined as any person who uses or accesses the Portal through a computer and/or any communication or device (hereinafter, the "User"), fully and unreservedly accepts each of the provisions included in this Privacy Notice.

DATA CONTROLLER.

Nema Systems SAPI de CV (hereinafter the "Company") prioritizes the security of its Users, protecting their personal data through the use, application, and maintenance of high technical, physical, and administrative security measures.

As a User, you have the opportunity to choose from a wide range of products and services through our Portal, knowing that your personal data will be protected and handled confidentially. The CONTROLLER responsible for collecting, processing, and/or using the personal data provided by the User through the Portal is the Company, as well as its subsidiaries, affiliates, parent companies, and associated entities.

For purposes of this privacy notice, the Company designates the address of Adolfo Prieto #1324, Suite 301, Del Valle Centro, Benito Juárez, Mexico City, C.P. 03100 as its individual address.

PERSONAL DATA THAT MAY BE COLLECTED.

The personal data that the Company may collect from the User when using the Portal and/or contracting our services and products includes:

  1. Email, first and last name, phone number, gender, birthdate

PURPOSES OF PERSONAL DATA PROCESSING.

The personal data collected by the Company will be used for the following purposes:
    1. We will collect user data so that businesses can identify their customers, contact them, and access analyses we perform. They will only have access to this information if the customer downloads the loyalty card of the respective business.
    2. To create files, databases, and systems necessary for carrying out the relevant operations and services;(ii) To claim rewards and/or promotions; (iii) To conduct internal analyses.
    3. Additionally, your personal data may be used for the following secondary purposes:
    • (i) Marketing, advertising, and commercial prospecting;
    • (ii) Offering additional products and services of the Company or any of its affiliates, subsidiaries, parent companies, associated companies, agents, or companies;
    • (iii) Sending promotions of other goods, services, and/or products;
    • (iv) Conducting statistical analysis, information modeling, and/or behavioral and predictive profiling; and
    • (v) Participating in surveys, contests, and promotions.

OPTIONS AND MEANS TO LIMIT THE USE OR DISCLOSURE OF DATA.

The Company has implemented administrative, technical, and physical security measures to protect your personal data, which we also require from the service providers we hire. You may limit the use or disclosure of your personal data by sending an email to [email protected] indicating your full name and the data you wish not to be disclosed. If your request is approved, you will be added to the exclusion list.

MEANS TO EXERCISE ACCESS, RECTIFICATION, CANCELLATION, OR OBJECTION RIGHTS (ARCO RIGHTS).

You may send an email to [email protected], at any time to exercise your Access, Rectification, Cancellation, or Objection Rights (“ARCO Rights”). To exercise ARCO Rights, you (or your legal representative) must submit a request, identifying yourself with the following documents:

  1. Name of the user or holder.
  2. Address of the user or holder or another means to communicate the response to your request.
  3. Documents proving your identity (IFE/INE or passport) and, if applicable, the documents proving the legal representation of the applicant.
  4. A description of the information/data on which you are trying to exercise your ARCO Rights and the rights you wish to exercise.

If one or more of the required documents are missing and/or contain errors or omissions, the Company will notify you within 3 business days of receiving the request, asking for the missing documents and/or corrections; you will have 5 business days from this notification to provide the updated information, otherwise, the request will be deemed not submitted.

TRANSFER OF PERSONAL DATA.

The Company may disclose your personal data to those third parties who, due to the services and products offered, need to know it to fully comply with them.

Likewise, the Company may disclose your information to competent authorities in accordance with applicable law; any transfer of your personal data without consent will be made in accordance with Article 37 of the LFPDPPP.

WEB BEACONS.

The Company may or may not use tracking technologies such as web beacons, similar to cookies, to collect data on your visits to the Portal; these are small electronic images embedded in web content or emails, generally invisible to Users, which allow us to create nearly personalized content to offer you a better experience when using our Portal.

If you disagree with any of the conditions established here, the User can always change their browser settings.

CHANGES TO THE PRIVACY NOTICE.

This privacy notice may undergo modifications, changes, or updates resulting from, among other things, new legal requirements, the Company's own needs due to the products or services we offer, our privacy practices, changes to our business model, or other causes.

Any modification to this privacy notice will be notified through any of the following means: a written communication sent to your address, by the email you provide, a message to your mobile phone, a message announced through the Portal or any electronic means you use to conduct transactions, or in widely circulated newspapers within the Company's registered address.
